Abstract

This research aims to examine the crime of premeditated persecution that resulted in death, focusing on the analysis of the Semarang District Court Decision Number.185/Pid.B/2024/Pn.Smg. This research is a normative legal research with legislative approach and concept approach. Legal materials were collected through literature study. Analysis of legal materials is carried out by quoting and reviewing relevant laws and regulations, as well as quoting the opinions of experts which are used as a basis for answering the formulation of research problems.

Based on the results of the discussion of the legal issues raised, it can be concluded that this research was conducted to understand how the elements of the crime of premeditated persecution resulting in death are regulated in the old Criminal Code (KUHP) and the National Criminal Code, as well as to analyze the basis of the judge's legal considerations in sentencing the case. In the case analyzed, the defendant Aditya Eka Saputra was involved in a brawl that ended in the death of the victim. The court found the defendant guilty of premeditated maltreatment resulting in death pursuant to Article 353 paragraph (3) of the Criminal Code. With this research, it is hoped that it will make a theoretical contribution to the development of legal science and provide practical benefits for law enforcement related to persecution resulting in death.
